TABLE OF VIOLATIONS AND SANCTIONS

This Table of Violations and Sanctions (the "Sanctions Table") is issued to interpret and apply the corresponding sanctions for behaviors that violate the "Code of Conduct for Service Providers." The objective of Vua Thợ is to build a fair, transparent, and consistent enforcement process, ensuring the rights and responsibilities of Customers, Service Providers, and the Vua Thợ platform.

Relationship with the Code of Conduct (CoC)

This Sanctions Table is an inseparable part of the Code of Conduct. Each behavior listed below is referenced to one or more specific articles within the CoC. Adherence to the Code of Conduct and the regulations within this Sanctions Table is a mandatory obligation for every Service Provider operating on the Vua Thợ platform.

General Principles of Sanctions

  • Definitions of Sanctions:
    • Warning: Vua Thợ will issue an official notification of reprimand via the Application regarding the violation. A subsequent violation may lead to a more severe form of sanction.
    • Temporary Suspension of Cooperation (time-based): The Service Provider's account will be temporarily locked, rendering them unable to log in or receive new Work Orders for a specific period (e.g., 3 days, 7 days).
    • Permanent Termination of Cooperation: The cooperation agreement will be permanently terminated. The account will be locked, and the Service Provider will be unable to re-register on the Vua Thợ platform using the previously provided information.
  • Offense Reset Period Principle:
    • A violation will be considered a repeat offense (2nd, 3rd time) if it occurs within 180 days of the previous violation. After 180 days without a repeat offense, the next violation of the same behavior will be considered and processed as a 1st-time offense. This principle does not apply to violations that result in Permanent Termination of Cooperation on the first instance.
  • Principle of Comprehensive and Objective Review:
    • Consideration of Context (Aggravating/Mitigating Factors): Vua Thợ reserves the right to review the actual context of each incident. Factors such as the extent of damages, the cooperative attitude of the Service Provider, and other relevant elements will be considered to ensure the final decision is as reasonable as possible.
    • Multiple Violations in a Single Incident: If a Service Provider commits multiple different violations within the same Work Order, Vua Thợ will apply the sanction corresponding to the most severe violation. The other violations will be considered as aggravating factors.
  • Rights of Vua Thợ:
    • Right of Decision: The decision of Vua Thợ, made based on these principles and procedures, shall be final and binding, and the Service Provider agrees to comply with it.
    • Unlisted Behaviors: For behaviors not yet listed in this Sanctions Table but deemed capable of negatively affecting the safety, service quality, or reputation of Vua Thợ, the Company has the full right to impose an appropriate sanction, up to and including Permanent Termination of Cooperation.
    • Referral to Competent Authorities: For acts that show signs of criminal or civil law violations, Vua Thợ reserves the right to temporarily lock the Service Provider's account and transfer all information and details of the case to the competent state authorities for investigation and handling.
  • Effectiveness:
    • This Sanctions Table is effective from the date of issuance and will be updated periodically. The Service Provider is responsible for monitoring and complying with the latest version.

PART A: ATTITUDE AND BEHAVIOR

CATEGORY A1: PROFESSIONALISM

A1.1

Non-compliance with regulations on uniform and professional appearance. (Including behaviors such as: wearing incorrect uniform; dirty or torn uniform; failing to present the Service Provider ID number upon request).

Brokering or transferring Work Orders to other technicians (within or outside the system) to perform on one's behalf.

Cancellation Fraud (intentionally not performing an accepted Work Order, or asking the customer to cancel for an unjustifiable reason).

Lần 2: Temporary Suspension of Cooperation for 7 days.

Fraud in Service Performance (intentionally performing the wrong service or incorrect technical procedure for personal gain).

Financial Dishonesty (not collecting the correct amount shown on the application, not returning excess change to the customer). Misappropriation of high-value assets may result in Permanent Termination on the first offense.

CATEGORY A2: RESPECT

A2.1

Disrespectful Communication (using impolite, profane, crude language, or insulting customers or Vua Thợ staff). If the act causes severe consequences, Permanent Termination may be applied on the 1st offense.

Lần 2: Temporary Suspension of Cooperation for 7 days.

Discrimination (refusing service or using derogatory language/actions towards customers based on race, religion, gender, or region).

Violation of Privacy (unauthorized photography or filming of customers or their private residence; disclosing customer's personal information to third parties).

CATEGORY A3: SAFETY

A3.1

Violation of labor safety regulations (not using protective gear, performing dangerous actions that could harm oneself or the customer). If the act causes severe consequences, Permanent Termination may be applied on the 1st offense.

Lần 2: Temporary Suspension of Cooperation for 7 days.

Harassment, Threats, or Assault (sexual advances, sexual harassment, verbal or physical threats, physical assault against a customer).

Lần 1: Permanent Termination of Cooperation, and Vua Thợ will proactively provide information to competent state authorities for legal processing.
A3.3

Causing injuries or harming the health of the customer due to negligence during service execution. If the act causes severe consequences, Permanent Termination may be applied on the 1st offense.

Lần 1: Temporary Suspension of Cooperation for 7 days, and a requirement to rectify and compensate for all damages caused to the customer.

Use of Stimulants (consuming alcohol, beer, or other prohibited substances during the performance of a service).

PART B: PROFESSIONAL OPERATIONS

CATEGORY B1: SERVICE QUALITY

B1.1

Low Average Star Rating: The average star rating (based on the last 50 reviews) falls below 4.6 stars.

Lần 2: Temporary Suspension of Cooperation for 7 days and a requirement to participate in a service quality improvement course.
Lần 3: Permanent Termination of Cooperation.
B1.2

High Cancellation Rate: The rate of cancellations initiated by the Service Provider exceeds 15%. Only applies to cancellations without a justifiable reason accepted by Vua Thợ.

Lần 3: Temporary Suspension of Cooperation for 7 days.
B1.3

Soliciting or demanding off-the-book fees: Asking or suggesting that the customer pay extra fees not included in the finalized quote on the application.

B1.4

Poor Workmanship Quality: Performing work with incorrect techniques or specifications, leading to damages or requiring multiple warranty claims/re-dos. Applied based on verified complaints from customers.

Lần 2: Temporary Suspension of Cooperation for 7 days and a requirement to retake the skill test.

CATEGORY B2: SYSTEM HONESTY AND TRANSPARENCY

B2.1

Using fraudulent documents or information to register or verify an account.

Lần 1: Permanent Termination of Cooperation.
B2.2

Violation of account regulations: Registering more than one Service Provider account, or sharing, leasing, or selling an account for others to use. Operating under another person's account may result in Permanent Termination on the 1st offense.

Lần 2: Permanent Termination of Cooperation.
B2.3

Abuse of promotional programs or bonuses (creating fake Work Orders, colluding with other users for personal gain).

Lần 2: Permanent Termination of Cooperation.
B2.4

Use of fraudulent software (using applications or tools to interfere with the Vua Thợ system to gain an unfair advantage).

Lần 2: Permanent Termination of Cooperation.

Engaging in off-platform transactions (accepting a Work Order on the application but then canceling it to deal privately with the customer to evade platform fees).

CATEGORY B3: COOPERATION AND PLATFORM COMPLIANCE

B3.1

Non-cooperation with Vua Thợ (refusing to provide information or documents when requested; displaying an uncooperative or defiant attitude towards Vua Thợ support staff).

Lần 2: Permanent Termination of Cooperation.
B3.2

Spreading false information that negatively affects the reputation of Vua Thợ, other Service Providers, or customers on media or social networks.

Lần 1: Temporary Suspension of Cooperation for 7 days.

B3.3

Advertising for competitors during the performance of a Vua Thợ Work Order.

Lần 1: Temporary Suspension of Cooperation for 7 days.

B3.4

Failure to participate in mandatory training or briefing sessions as required by Vua Thợ.

Possessing, transporting, using drugs, alcohol, beer, stimulants, and other illegal activities; using alcohol, beer, tobacco, or stimulants while providing services to customer.

Lần 1: Permanent cooperation termination and Vua Thợ may refer the matter to the competent state authority for processing according to legal regulations.
B3.6

Committing illegal acts, including but not limited to: causing injuries, verbal harassment, sexual assault, coercion, murder, kidnapping, threats.
